FAILURE TO FOLLOW PROCESS
Any and all items that are brought into the Health System for evaluation must follow the process outlined above. Failure to follow these procedures by submitting items directly to individuals, doctors, or departments may result in forfeiture of the item(s) by your company without remuneration as an “unsolicited gift” of goods or services.
Furthermore, any attempt to influence the decision regarding acceptance of an item by providing goods, monetary gifts or services to a UHS employee or their family members will result in a rejection at the time and the individual providing the gratuity will be banned from doing business with the Health System for a minimum period of one year. This incident will also be referred to the Integrity Department
The Director of Strategic Sourcing will, by written notice to the Vendor, cancel any contract or purchase order, without liability to the Vendor/Seller, it if is determined by the Director of Strategic Sourcing that gratuities, in the form of entertainment, gifts or otherwise, were offered or given by the Vendor/Seller or any agent with a view toward securing a contract or securing favorable treatment with respect to the performing of the contract or purchase order. In the event a contract or purchase order is cancelled by the Director of Strategic Sourcing pursuant to this provision, the Health System shall be entitled, in addition to any rights and remedies, to recover or withhold the amount of the cost incurred by Seller in providing such gratuities.
